General terms and conditions, delivery and payment conditions (GTC) of Joss Trading

1. Validity:

All product and service offers on the website www.little-bijou.ch are intended exclusively for end users. The following general terms and conditions apply to all contracts concluded between end users (hereinafter referred to as "buyers") and the online shop on www.little-bjou.ch by JOSS TRADING (hereinafter referred to as "seller"). For the business relationship, the purchase of products and services from the website www.little-bjou.ch does not involve any business activity on the part of the buyer. The version of the general terms and conditions valid at the time the contract is concluded applies to each purchase contract. Any changes must always be made in writing.

2. Conclusion of the purchase contracts:

By placing an order, the buyer declares binding acceptance of the offer and the seller declares receipt of the order. The order is accepted exclusively by sending an order confirmation. The contract is only concluded when the written order confirmation is sent by email. The seller is entitled to refuse acceptance of the order without stating reasons. Any rejection must be in writing. The prerequisite for this is the provision of a valid email address. The seller also has the right to limit quantities to quantities customary for consumers.

The content of the purchase contract, including the general terms and conditions valid at the time of conclusion of the contract, is archived on data media and sent to the buyer by email. The buyer can correct any incorrect information in the order by notifying us in writing.

3. Terms of payment and delivery:

The prices at the time of the order are binding. This does not apply to items that are not in stock and must go into production at the time of the order. For these items, prices may change if there is a significant change in market conditions (change in the relevant raw material and exchange rates by more than ten percent).

Our company is not subject to VAT.

The items are shipped via Liechtenstein/Swiss post. The shipping fees will be charged to the customer as follows:

CH/FL: CHF 6.30 (from an order value of CHF 50.00 = free shipping)

Europe: CHF 38.00 per order

International: CHF 50.00 per order

Customs and VAT fees in the receiving country are always borne by the recipient.

Payment for the order must be made in advance by bank transfer.

Offsetting against any mutual claims is not permitted unless these are undisputed and legally recognised.

Deliveries are only made in Switzerland and the Principality of Liechtenstein. The billing and delivery addresses must be in the same country.

All deliveries are made while stocks last. The different times until the items are available are indicated in the ordering system by markings. No legal claim is derived from this.

If the items ordered in accordance with the purchase contract cannot be delivered for reasons for which the buyer is responsible, the buyer must bear the costs of returning the items to the seller. This does not apply in the event of cancellation.

4. Retention of title and transfer of risk:

The delivered items remain the property of the seller until the purchase price has been paid in full. The delivered goods may not be used for collateral purposes or other forms of security. In the event of seizure or confiscation, the buyer must inform the seller immediately.

The risk for the items passes to the buyer upon acceptance of the shipment. Delivery is also deemed to have been handed over if the buyer is in default of acceptance.

In case of late payment or other breach of contract, the seller is entitled to withdraw from the purchase contract and demand the return of the items.

5. Warranty and Liability:

The statutory warranty claims apply to all deliveries. In the event of defects (= product defects, incorrect deliveries, quantity errors), the buyer has the choice of insisting on repair or replacement delivery. If this would entail disproportionately high costs, the seller can refuse to repair in the true sense of the word and in the circumstances, by carrying out the alternative form of repair chosen by the seller in a form that does not cause the buyer any significant disadvantages. If appropriate repair is not carried out, the buyer has the right to a reduction in price or to cancel the contract by withdrawing from the contract.

In the case of slightly negligent breaches of contract, the liability of the seller or one of its legal representatives or vicarious agents is limited to the foreseeable, contract-typical, immediate average damage. The liability limitations do not apply to claims under the Product Liability Act, damage to health attributable to the seller, or loss of life of the buyer.

6. Right of withdrawal / cancellation:

You can revoke your contractual declaration within 14 calendar days without giving reasons in text form (e.g. letter, fax, email) or by returning the item. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery. To comply with the cancellation period, it is sufficient to send the cancellation or the item in good time. Please send your written cancellation to info@little-bijou.ch.

Personalized items are explicitly excluded from the right of withdrawal.

7. Consequences of revocation:

In the event of an effective cancellation, the services received by both parties must be returned and any benefits derived (e.g. interest) must be surrendered. If the service received and benefits (e.g. benefits of use) cannot be returned or surrendered in whole or in part or only in a deteriorated condition, JOSS TRADING only has to pay compensation to that extent. For deterioration of the item and for benefits derived, you only have to pay compensation to the extent that the use or deterioration is due to handling of the item that goes beyond checking its properties and functionality. "Checking the properties and functionality" means testing and trying out the respective goods, as is possible and usual in a store, for example. Obligations to refund payments must be fulfilled within 30 days. For you, the period begins when you send your cancellation notice or the item, and for us when we receive it.

Please send all items you wish to return in their original packaging (to protect them from damage during transport). Please note that a return may take a few days to arrive by post and that our return process also requires a certain amount of processing time.

8. Final provisions:

The place of jurisdiction for disputes is Vaduz. However, JOSS TRADING is entitled to sue the customer at the court of his or her place of residence.

Applicable law: Liechtenstein law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Unless and insofar as the General Terms and Conditions do not provide otherwise, the provisions of the General Civil Code (ABGB) or corresponding special legislation of Liechtenstein apply. Changes to these General Terms and Conditions must be made in writing. Changes will be communicated to the customer in an appropriate manner. Should individual provisions of these General Terms and Conditions be or become invalid, the remaining content of the General Terms and Conditions or their validity remain unaffected. Subsequent changes or additions to these General Terms and Conditions become part of the contract if the customer does not object to the changed provisions in writing within one month of becoming aware of them.
