General terms and conditions, delivery and payment conditions (GTC) of Joss Trading

1. Validity:
All product and service offers on the website www.little-bijou.ch are intended exclusively for final consumers. The following general terms and conditions apply to all contracts concluded between end consumers (hereinafter referred to as “buyer”) and the online shop on www.little-bjou.ch by JOSS TRADING (hereinafter referred to as “seller”). For the business relationship, the purchase of the products and services from the website www.little-bjou.ch does not involve any business activity on the part of the buyer. The version of the General Terms and Conditions valid at the time the contract is concluded applies to every purchase contract. Any changes must always be made in writing.
2. Conclusion of purchase contracts:
By placing an order, the buyer declares binding acceptance of the offer and the seller declares receipt of the order. The order is accepted exclusively by sending an order confirmation. The contract is only concluded when the written order confirmation is sent via email. The seller is entitled to refuse to accept the order without giving reasons. Any rejection must in any case be in writing. The prerequisite for this is that you provide a valid email address. The seller also has the right to limit quantities to the quantities customary for consumers.
 
The content of the purchase contract, including the general terms and conditions valid at the time of conclusion of the contract, will be archived on data media and sent to the buyer by email. The buyer can correct any incorrect information in the order by notifying us in writing.
 
3. Payment and delivery conditions:
The prices at the time of ordering are binding. This excludes non-stock items that must be put into production at the time of ordering. Price changes for these items are possible if there are significant changes in market conditions (changes in the relevant raw material and foreign exchange rates of more than ten percent).
Our company is not subject to VAT.
 
The items are shipped via Liechtenstein/Swiss post. Shipping fees will be charged to the customer as follows:
CH/FL: CHF 6.30 (from an order value of CHF 50.00 = free shipping)
Europe: CHF 38.00 per order
International: CHF 50.00 per order
Customs and VAT fees in the receiving country are always borne by the recipient.
 
Payment for the order must be made in advance by bank transfer.
 
Offsetting any mutual claims is not permitted unless they are undisputed and legally recognized.
 
Deliveries are made exclusively in Switzerland and the Principality of Liechtenstein. In any case, the billing and delivery addresses must be in the same country.
 
All deliveries are made while stocks last. In the ordering system, the different times until the items are available are made visible through labeling. A legal claim does not arise from this.
 
If the items ordered in accordance with the purchase contract cannot be delivered for reasons for which the buyer is responsible, the buyer must bear the costs of returning them to the seller. This does not apply in the event of cancellation.
 
4. Retention of title and transfer of risk:
The delivered items remain the property of the seller until the purchase price has been paid in full. The delivered goods may not be used for deposit purposes or other forms of security. In the event of seizure or confiscation, the buyer must inform the seller immediately.
 
The risk for the items passes to the buyer upon acceptance of the shipment. A handover occurs even if the buyer is in default of acceptance.
 
In the event of late payment or other behavior that violates the contract, the seller is entitled to withdraw from the purchase contract and demand the return of the items.
5. Warranty and liability:
The statutory warranty claims apply to all deliveries. In the event of defects (= product defects, incorrect deliveries, quantity errors), the buyer has the choice of insisting on repairs or a replacement delivery. If costs are disproportionately high, the seller can refuse to carry out repairs in the actual sense and circumstances if he carries out the alternative form of repair chosen by the seller in a form that does not bring any significant disadvantages to the buyer. If appropriate repairs are not carried out, the buyer has the right to a reduction or cancellation of the contract by withdrawing from the contract.
 
The liability of the seller or one of his legal representatives or vicarious agents in the event of slightly negligent breaches of contract is limited to the foreseeable, direct average damage typical of the contract. The limitations of liability do not apply to claims arising from the Product Liability Act, damage to health attributable to the seller or loss of life of the buyer.
6. Right of withdrawal / right of withdrawal:
You can revoke your contractual declaration within 14 calendar days without giving reasons in text form (e.g. letter, fax, email) or by returning the item. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring delivery of similar goods, not before receipt of the first partial delivery. Personalized items are explicitly excluded from the right of withdrawal.

7. Consequences of revocation:
In the event of an effective revocation, the services received by both parties must be returned and, if necessary, benefits derived (e.g. interest) must be returned. If the received service and benefits (e.g. benefits of use) cannot be returned or returned or given back in part or only in a deteriorated condition, JOSS TRADING must only pay compensation to this extent. You only have to pay compensation for deterioration of the item and for any use that has been made if the use or deterioration is due to handling of the item that goes beyond checking the properties and functionality. “Testing the properties and functionality” means testing and trying out the respective goods, as is possible and usual in a store. Obligations to refund payments must be fulfilled within 30 days. The period begins for you when you send your cancellation declaration or the item, and for us when we receive it.

Please send all items you want to return in the original packaging (to protect against damage in transit). Please note that a return can take a few days to be sent by post, and our return of goods also requires a certain processing time.

8. Final provisions:
The place of jurisdiction for disputes is Vaduz. However, JOSS TRADING is also entitled to prosecute the customer at his or her place of residence.
Applicable law: Liechtenstein law excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Unless and to the extent that the General Terms and Conditions do not provide anything special, the provisions of the General Civil Code (ABGB) or corresponding special legislation of Liechtenstein apply. Changes to these terms and conditions must be made in writing. Changes will be announced to the customer in an appropriate manner. Should individual provisions of these General Terms and Conditions be or become ineffective, the remaining content of the General Terms and Conditions or their effectiveness will remain unaffected. Subsequent changes or additions to these General Terms and Conditions will become part of the contract if the customer does not object to the changed provisions in writing within one month of becoming aware of them.
